Terms of Use — CrushIt

1. Acceptance of Terms

By downloading, installing, or using the CrushIt application ("the Application"), you acknowledge that you have read, understood, and agreed to these Terms of Use ("the Terms").

If you do not accept these Terms, you must not use the Application.

The Application is operated by The CrushIt Team ("we", "our"). These Terms constitute a legally binding agreement between you and us.

You must be at least 17 years old to use CrushIt, in accordance with Apple App Store requirements.

2. Service Description

CrushIt is a wellness and lifestyle application designed to help users reduce or quit tobacco and nicotine consumption. It offers:

• Daily progress tracking with streak and level system
• Savings calculation based on your declared habits
• An AI-powered conversational assistant
• A community chat space with reporting and blocking tools
• Distraction mini-games and wellness tools
• A personal journal
• Motivation and reminder notifications

We reserve the right to modify, suspend, or discontinue all or part of the Application's features at any time, with or without notice.

3. Important Medical Disclaimer

CrushIt is not a medical device and does not constitute a health service.

The Application is a behavioral and motivational support tool. It does not replace:

• Professional medical advice, diagnosis, or treatment
• Follow-up by a doctor, pharmacist, or any other healthcare professional
• Nicotine replacement therapies (patches, gum, prescription medications)

If you experience significant withdrawal symptoms, health problems, or any other medical concerns related to quitting smoking, consult a qualified healthcare professional.

The CrushIt Team cannot be held responsible for consequences arising from using the Application as a substitute for medical advice.

4. Account Creation and User Responsibilities

4.1 Your Account

To use certain features of CrushIt, you may need to create a profile with a username and photo. You are responsible for:

• The accuracy of the information you provide
• The confidentiality of your login credentials
• All activities carried out from your account

4.2 User Content

You retain ownership of all content you create in the Application (journal entries, chat messages). By posting content in the community space, you grant us a limited, non-exclusive, royalty-free license to display this content within the Application.

4.3 Your Commitments

By using CrushIt, you agree to:

• Use the Application in accordance with applicable laws in Quebec and Canada
• Not attempt unauthorized access to our systems or servers
• Not use the Application for illegal, abusive, or fraudulent purposes
• Provide truthful information when setting up your profile

5. Subscription, Payment and Cancellation

5.1 Subscription Model

CrushIt offers premium access through a paid subscription. A free trial may be offered depending on conditions available at the time of your registration.

5.2 Payment Processing

All payments are processed exclusively by Apple via the App Store. The CrushIt Team does not collect, store, or process any payment or credit card information.

Applicable prices are those displayed in the App Store at the time of purchase and may vary by region.

5.3 Automatic Renewal

Your subscription automatically renews at the end of each period unless cancelled at least 24 hours before the renewal date.

5.4 Cancellation

You can cancel your subscription at any time directly via:

iPhone Settings → [Your Name] → Subscriptions → CrushIt

Cancellation takes effect at the end of the current subscription period. No refund is provided for the period already paid, except as provided by Apple's refund policy.

5.5 Price Changes

We reserve the right to modify subscription prices. Any changes will be communicated via the App Store or by notification in the Application, with reasonable notice.

6. Code of Conduct — Community Chat

CrushIt's community chat is a space for mutual support and encouragement. By using it, you agree to follow these rules.

6.1 Prohibited Behaviors

It is strictly forbidden to post content that is:

• Harassing, intimidating, or threatening to other users
• Discriminatory based on race, origin, sex, religion, sexual orientation, or any other grounds
• Sexually explicit or pornographic
• Promoting illegal substances or activities
• Containing personal information about others without their consent
• Spam, unsolicited advertising, or misleading content
• Infringing on third-party intellectual property rights

6.2 Moderation

We reserve the right, without obligation, to monitor, modify, or remove any content that violates these rules, at our sole discretion.

Users have access to a built-in reporting tool allowing them to submit a report on any message deemed inappropriate. It is also possible to block a user, which prevents their messages from being displayed in your conversation thread. These tools are provided to maintain a healthy environment but do not guarantee the immediate removal of reported content.

User reporting of inappropriate content is encouraged.

6.3 Responsibility

You are solely responsible for the content you post in the community chat. The CrushIt Team cannot be held responsible for exchanges between users.

7. AI Assistant — Limitations and Warnings

7.1 Nature of the Service

The conversational assistant integrated into CrushIt is powered by a language model (artificial intelligence) whose responses are automatically generated. Responses may contain inaccuracies, imprecisions, or incomplete information.

7.2 What the AI Assistant Is Not

The AI assistant's responses do not constitute:

• Medical, psychiatric, or psychological advice
• Prescriptions or therapeutic recommendations
• Personalized medical follow-up

7.3 Responsible Use

We encourage you to use the AI assistant as a motivational and general information tool only. For any health questions, consult a qualified professional.

The CrushIt Team disclaims all responsibility for decisions made based on responses generated by the AI assistant.

8. Intellectual Property

8.1 Application Content

All CrushIt content — including but not limited to the name, logo, design, texts, graphics, mini-games, source code, and features — is the exclusive property of The CrushIt Team and is protected by Canadian and Quebec copyright and intellectual property laws.

Any reproduction, distribution, modification, or commercial use of this content without prior written authorization is strictly prohibited.

8.2 User Content

You retain full ownership of the content you create in the Application (personal journal, messages). By posting in the community space, you only grant us the right to display this content to other CrushIt community users, without any transfer of ownership on your part.

9. Push Notifications

By enabling push notifications in CrushIt or in your device settings, you consent to receive communications from us, including:

• Daily motivation reminders
• Streak-related alerts
• Personalized encouragement based on your progress

You can withdraw your consent and disable notifications at any time via:

iPhone Settings → Notifications → CrushIt

or directly in the Application settings. Disabling notifications does not affect access to the Application's main features.

10. Account Suspension and Termination

10.1 Termination by User

You can stop using CrushIt and delete the Application at any time. Deleting the Application results in the loss of data stored locally on your device.

10.2 Suspension or Termination by CrushIt

We reserve the right to suspend or terminate your access to the Application, with or without notice, in the following situations:

• Violation of these Terms of Use
• Abusive behavior in the community chat
• Fraudulent activity or attempted unauthorized access
• Non-payment of applicable fees

10.3 Consequences of Termination

In case of termination, your access to premium features will be immediately revoked. Data stored locally will remain on your device until you uninstall the Application. Community chat messages may be retained or deleted at our discretion.

11. Limitation of Liability

To the maximum extent permitted by law, The CrushIt Team disclaims all liability for:

• Any direct, indirect, special, incidental, or consequential damages arising from the use or inability to use the Application
• Data loss due to technical failure, device change, or Application deletion
• Inaccuracies in information provided by the AI assistant
• Interactions between users in the community chat
• Health consequences related to quitting smoking or nicotine use

The Application is provided "as is" without any warranty, express or implied, including warranties of merchantability or fitness for a particular purpose.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. In case of significant changes, we will notify you via an in-app notification or a visible notice when you next open the Application.

Your continued use of the Application after publication of the changes constitutes acceptance of the new Terms.

The date at the top of this document always indicates the current version.

13. Applicable Law and Jurisdiction

These Terms are governed and interpreted in accordance with the laws in force in the Province of Quebec, Canada, without regard to conflict of laws principles.

Any dispute arising from these Terms or related to the use of CrushIt will be submitted to the exclusive jurisdiction of the courts of the judicial district of Montreal, Quebec.
